Let me lay down what happened.
Cops hit the scene. Guys are drug dealing; several reports (phoney or otherwise). They search out the guys and as-is, they have no right to search them or anything and they know it.
Cops approach a representative of the motel and request to search the room. When you sign that motel contract for the night, you're allowing them to comply with police searches. Which means you've consented to allowing them to search your room should hotel mangement say OK. Same thing with leasing an apartment or house; read the fine print. If the cleaning lady was the only one on the premisis at the time, she is management.
Cops search the room, don't find any drugs. They search a waste bin, find pot seeds. Weak evidence but it gets their conviction up and gets them excited since they've got a quota and if they fulfill it, they get raises.
They confront the 3 black guys and intimidate them as a tactic to get them afraid and confess. At this point, they have no evidence.
How would I have reacted in this situation?
1:
Cop: "If you do not tell me where the drugs are I will tase you".
Me: "Sir, may I get your name and badge ID or business card?"
Cop: Cop will give you the information. If they do not, then state to them you are going inside with your friends as they have no legal right to detain you as they are not cops. Write it down, and start writing.
Me: Sir, that is a verbal threat. I understand you are intimidating me, however, as-is you have no evidence and I am non-combative. This action reflects very poorly upon the professional conduct I expect from my department and compromises both their saftey and professional trust. I will be reporting your actions to the sheriff.
Additionally, I would very much like to see you tase me. You have no evidence. I will press assualt charges, talk to the sheriff and request your termination for excessive use of force, and I will sue your department for damages. That will get the cop to back off; you are stating you know your rights.
2: Consent to the search if you have nothing to hide; this will gain the cops trust and make them feel guilty. I had a cop come up to me once, a female, mabye 200 pounds. She said "I had a 911 call from this location for domestic violence". I stated nobody is here but myself, accounted for everyone who lived in the home, and stated I made no such call. She said "Can I look around", I said, as friendly as can be "Sure". . 3 minutes later she's sweating hard and has an adrenaline rush not knowing what to expect as I show her around each room; I'm well over 400 pounds and can easily kill her at a moments notice so she's a bit freaked. Nobody is home, she has nothing. She leaves, confused and rather distressed, I tell her "Thanks for checking up Ma'am, have a nice day! I hope you find the jackass!" and leave. I know she was feeling rather dirty, afraid, and confused after doing that. After the first few rooms she didn't want to search anywhere else I even said to her "Well there's the garage over there and a crawl space down here".
If you plain don't like being searched, state "I do not consent to any searches Sir" and lock your briefcase/backpack, etc. If they want to search they will try any weak-ass excuse they can find, and they'll treat you as much of an ass as you treat them. Quite simply, they take shit day in and day out, and they love nothing more than to deal it. 10 assholes treat them like shit and the 11th makes the mistake, so the 11th get all the shit the 10 dished out. That's how it works.
More than likely the cop was going to tase buddy because he was getting up in his face and getting angry from being threatened. Most people react and become combative when threatened by police; it's stupid of the police to do it.

Thanks tryrranzxx. I guess I should have realized that.
Your idea to get tasered and sue won't work our for you if you're one of the unlucky 2%? who die.
I'm not sure about a solution to this. The search law is fine for catching lawbreakers, but blows for the innocent, or those who break victimless and/or BS laws.
Who decided tasers were such a great idea for ALL cops to carry?
My guess: the taser manufacturer.

I vote for don't consent to a search, ever, unless they have the warrant.tyrranzzx wrote:Consent to the search if you have nothing to hide; this will gain the cops trust and make them feel guilty.
In fact, don't even let them in your house upon greeting them, not a foot over the threshold without a warrant. Step outside and close the door behind you to converse. By letting them in, you open your own can of worms. Who cares if they come up with nothing and feel guilty? I'd rather make them feel stupid for trying to break the law on my property. Show me that a judge thinks you have a damn good reason to pilfer through my livingroom. Otherwise, beat sand, Copper. That is your constitutional right, and you should hold on dearly to every single one you can still exercise.

the cops searched the room after asking a house cleaner they never talked to management.
The cops here also deal drugs and have for years and they let their relatives deal drugs.
these 3 black guys didn't do anything. the seeds could have come from anywhere. I know all the cops and went to school with them it is a VERY small town. I have seen some of the cops do drugs all be it before they were cops.
I had a cop pull a tazer on me for not wearing a seat belt before. Some of them are just pigs.
